deposits, nonrefundable

In many states it is illegal to accept a deposit. The word "deposit" makes a legally binding contract which can lead to a lawsuit. NEVER use "deposit". You may use "retainer", but beware as several states have laws about selling animals prior to that "magic age"..usually 6 to 8 weeks depending on where you live.

The most helpful advice is to consult a lawyer in your state.

I had a lawyer friend who is also a beagle breeder draw up my contracts, and deposits are apparently legal in NY State because my contracts include them.

I take a deposit and it's completely refundable for three days, or three days after the puppies are born, whichever is later. I will also refund the deposit if I can't provide a puppy for whatever reason. If the buyer backs out, the deposit stays but is applicable if they decide to buy a puppy from me in the future.

I say the money is to reserve a puppy of that sex and color. Is that legal?
